Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents herein to pay the sum of Rs.10,00,000/- toward compensation to the Petitioner for the death of his father Ranganathan on 15.02.2022 which had occurred due to the negligence of the Respondents herein within a stipulated period.

The writ petition is filed seeking compensation on the death of one Mr.Ranganathan, father of the writ petitioner.

2. The father of the writ petitioner admittedly died on account of electrocution. Deceased Mr.Ranganathan went to his lands on 15.02.2012 and accidentally came into contact with the snapped live eclectic lines and died.

3. A criminal case has been registered in Crime No.143 of 2012, under Section 174 Cr.P.C. Pursuant to the interim order, the respondents have already setted a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to the petitioner. However, as per the Board Proceeding No.6 dated 16.10.2019, the respondents are bound to settle a sum of Rs.5,00,000/- (Rupees Five Lakhs) to the victim. The death due to electrocution has not been disputed. Therefore, there is no impediment for settling the compensation amount of Rs.5,00,000/- (Rupees Five Lakhs) on compassionate ground to the petitioner by the respondents.

In view of the facts and circumstances, the respondents are directed to pay the balance compensation amount of Rs.3,00,000/- (Rupees Three Lakhs) along with the interest at the rate of 6% from the date of death of the person till the date of payment of the compensation, within a period of eight (8) weeks from the date of receipt of a copy of this order.
