ORDER

This writ petition has been filed, seeking for issuance of patta in the name of the petitioner.

2. As seen from the averments contained in the affidavit filed in support of this writ petition, the petitioner himself has admitted that the property for which patta is sought for is a "Wakf property". When the property is a Wakf property, the question of granting patta in favour of the petitioner does not arise.

3. On the last hearing date, i.e., on 22.01.2026, this Court directed the learned counsel for the petitioner to get instructions as this writ petition is not maintainable. Today, the learned counsel for the petitioner submits that though the property is a Wakf property, the petitioner seeks liberty to approach the Wakf Tribunal for seeking appropriate relief in the petitioner's favour in respect of the property. Such a liberty cannot be granted by this Court, since admittedly, the property is a Wakf property.

4. Since patta cannot be issued in favour of the petitioner for a Wakf property, the relief sought for in this writ petition cannot be entertained. This Court does not find any merit in this writ petition. Accordingly, this writ petition is dismissed. No Costs. Consequently, connected miscellaneous petition is closed.
