Respondent(s) PRAYER;This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to pass an order referring the petitioner to the Regional Medical Board of Rajiv Gandhi Government General Hospital, Chennai to verify his fitness/ disability for the post of Driver and to provide a permanent alternative employment with pay protection to the petitioner until his superannuation based on the report of the

medical board if the petitioner if found to be unfit for the post of driver, and also to continuously provide any temporary alternative employment to the petitioner till the completion of medical examination within a reasonable time as this Honble court may deem fit and proper to the facts and circumstances of this case.

ORDER

This petition has been filed seeking a direction to the 1st respondent to pass an order referring the petitioner to the Regional Medical Board of Rajiv Gandhi Government General Hospital, Chennai to verify his fitness/ disability for the post of Driver and to provide a permanent alternative employment with pay protection to the petitioner until his superannuation based on the report of the medical board if the petitioner if found to be unfit for the post of driver, and also to continuously provide any temporary alternative employment to the petitioner till the completion of medical examination.

It is the case of the petitioner that while the petitioner was working as a Driver in the first respondent, he met with an accident on 15.02.2025 sustaining multiple fractures and injuries and became unfit for the post of driver. Thereafter, temporary alternative duty was provided to him from 23.09.2025. From 21.11.2025, such alternative duty was stopped without verifying his fitness and to provide him a permanent alternative employment based on its

report and also to continuously provide any temporary alternative duty, till the completion of medical examination. However, no action was taken so far. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Standing Counsel appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent to consider and pass orders on the petitioner's representation dated 15.12.2025 and to refer the petitioner to the Medical Board, Rajiv Gandhi Medical College Hospital, Chennai to verify the fitness of the petitioner. The Dean, Medical Board, Rajiv Gandhi Medical College Hospital shall examine the petitioner and file a report to the respondents. Upon receipt of such report, the

second respondent shall pass appropriate order on merits and in accordance with law. The entire exercise shall be concluded within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of.
