O R D E R
This Civil Revision Petition has been filed under Article 227 of the Constitution of India seeking to set aside the judgment and decree passed in O.S.No.2666 of 2013 on the limited ground that the learned Trial Judge failed to take into consideration the judgment of the Division Bench in W.A.No. 278 of 2023 dated 15.04.2025.
3. Even according to the learned counsel for the petitioners, the decree was passed against defendants 1 and 2 declaring that they are not 2/6
the adopted children of the deceased Gracy, and simultaneously declaring the plaintiff as the sole legal heir of the said deceased Gracy. A decree for permanent injunction has also been granted restraining disbursal of pensionary benefits to defendants 1 and 2.
4. An effective statutory remedy of First Appeal under Section 96 CPC is available to the petitioners to canvass all grounds challenging the findings of the Trial Court. Instead of availing the said remedy, the petitioners have straightaway invoked the supervisory jurisdiction of this Court under Article 227 of the Constitution of India.
5. In view of the above, this Court is not inclined to entertain the present Revision, as an efficacious alternative remedy is available to the petitioners. It is, however, open to the petitioners to prefer an appeal, and in the event of any delay, to file an appropriate application under Section 14 of the Limitation Act seeking exclusion of the period spent in prosecuting the present Revision before this Court. The Appellate Court shall consider the same on its own merits and in accordance with law. 3/6
6. In the result, this Civil Revision Petition is dismissed with the above observation. Consequently, the connected miscellaneous petition is closed. No costs.
