C.M.P.No.10397 of 2016 in C.M.A.No.SR.45715 of 2016 V.M.VELUMANI,J.

This petition is filed to condone the delay of 717 days in filing the above Civil Miscellaneous Appeal.

2.The learned counsel for the petitioner/appellant submitted that the first respondent remained exparte before the Tribunal and hence, no notice is necessary for the first respondent.

3.Mr.S.Manohar, the learned counsel takes notice for the second respondent.

4.Considering the contention of the learned counsel for the petitioners, the delay of 717 days is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) to the 'High Court Legal Services Authority, Chennai', within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this Court. It is made clear that the petitioner/claimant shall not be entitled for any interest for the delay period in filing the appeal.
