Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the 1st Respondent in Na.Ka.3442/2012 Sa.Pa.dt.01.02.2013 quash the same and direct the respondents to pay the salary for the period between 5.01.2010 to 10.08.2010.

Learned counsel appearing for the petitioner during the course of arguments, restricted his prayer, even though writ petition sought for larger relief to quash the impugned order, requested to mould the relief and direct the second respondent to implement the order of the revisional authority, the first https://hcservices.ecourts.gov.in/hcservices/

respondent herein, within a time frame that may be fixed by this Court.

2. The learned Special Government Pleader appearing for the respondents would submit that the prayer now sought for by the counsel appearing for the petitioner would be considered and the second respondent will pass appropriate orders by implementing the order passed by the first respondent.

3. In view of the limited scope of the prayer sought for by the learned counsel appearing for the petitioner, without expressing any opinion on merit, this Court is inclined to direct the second respondent to consider the representation of the petitioner, dated 16.9.2011 and implement the order of the first respondent, dated 1.2.2013, regularise the suspension period and pay leave salary to the petitioner in sofaras the period between 5.01.2010 to 10.08.2010.

4. The writ petition is disposed of with the above direction. No costs.
