The Petitioner/A1, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 354 D, 509, 506(1) IPC and Section 67 of Information Technology Act 2000, Section 4 of TN Prohibition of Harassment of Women Act 2002 in Crime No.356 of 2023 on the file of the respondent police, seek anticipatory bail. 2.The defacto complainant is one Eswari aged 35 years W/o.Thirumalai, Varadhapuram Village, Pattaraiperumandur Post, Thiruvallur District.

3.The case of the prosecution is that the defacto complainant/victim is working in Sriram Finance and the accused/Petitioner approached her for obtaining a personal loan, which was refused by her and subsequently, he had taken the mobile phone number of the defacto complainant for insurance purpose and based upon the said mobile number, he had tracked her to her house and on 04.01.2023, at about 22.00 hrs, the petitioner herein has shoot a video while she was taking bath in her bathroom and thereafter, by showing the 1/ 4

video, he had threatened her and obtained Rs.3,00,000/- through G-Pay. Hence, the complaint.

4.The learned counsel for the Petitioner submitted that he is an ambulance driver and the defacto complainant has been falsely representing that she is unmarried. He further submitted that he had borrowed a sum of Rs.3,00,000/- from her and paid Rs.1,35,000/-. Since the defacto complainant is a married lady having two children and as he refused to marry her, a false case has been given.

5.The learned Government Advocate (Crl. side) submitted that the case is under investigation. He would further submit that this is a second anticipatory bail Petition and this Petitioner has already filed a Petition seeking anticipatory bail in Crl.OP.No.19369 of 2023 before this Court and this Court by order dated 12.09.2023, dismissed the same. 6.Heard the learned counsel for the Petitioner and the learned Government Advocate (Crl. side) appearing for the Respondent Police. 2/ 4

7.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the fact that this Court has already dismissed the first anticipatory bail Petition filed by the Petitioner and there is no change of circumstances, I am not inclined to grant anticipatory bail to the Petitioner.

8.Accordingly, this Criminal Original Petition is dismissed. 06.02.2024 sai 3/ 4
