PRAYER : Criminal Original Petition is filed under Section 439 Criminal Procedure Code praying to enlarge the petitioner on bail in the event of his arrest in Crime No.2168 of 2020 pending investigation on the file of the respondent.

O R D E R

(The case has been heard through video conference) The petitioner, who was arrested and remanded to Judicial custody on 08.12.2020 under Section 294(b), 452, 324, 506(ii) and 307 IPC in Cr.No.2168 of 2020 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that since the defacto complainant, who is a co-accused in a murder case, has refused to cooperate with the petitioner for their illegal activities , the petitioner along with other accused trespassed into the house of the defacto complainant and attacked him with billhook. Hence, the respondent police registered a case against the petitioner.

3. The learned counsel for the petitioner would submit that the petitioner has been falsely limplicated in this case only for statistical purpose. Hence, he prays to grant bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is a notorious criminal https://hcservices.ecourts.gov.in/hcservices/

and he is having five previous cases. Hence, he opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and the fact that the petitioner is having five previous cases, this Court is not inclined to grant bail to the petitioner.
