The matter is listed today under the caption "for being mentioned". 2.It is with respect to an order dated 29.01.2024 in Crl.O.P.No.223 of 2024, which application has been filed seeking modification of two conditions namely the condition to deposit the amount and for appearance before the respondent police.
3.In the order under question dated 18.12.2023, the learned Principal Sessions Judge, Tiruvarur, directed the petitioners to deposit a sum of Rs.10,000/- each to the credit of the Chairman/District Legal Services Authrity, Thiruvarur and also directed the petitioners to appear before the Inspector of Police, Muthupettai Police Station daily at 10.00 a.m., for a period of one month from the date of surrender. 4.In view of the above, the paragraph No.3 of the order dated 29.01.2024 is to be read as follows:
"3.Having considered the arguments advanced, the condition Nos.(i) and (iv) are modified to the effect that each one of the three petitioners shall deposit a sum of Rs.10,000/- to the credit of Crime 1/3
No.669 of 2023 and on such deposit, the learned District Munsif cum Judicial Magistrate, Valangaiman, may transfer the said amount in an interest earning fixed deposit in any one of the Nationalised Banks and pass final orders on conclusion of trial. If the petitioners are acquitted, the amount with interest may be handed over back to the petitioners and if the petitioners are convicted, the amount with interest may be handed over to the defacto complainant and the petitioners shall appear before the respondent police/the Inspector of Police, Valangaiman Police Station, everyday at 10.00 a.m., for a period of one month from the date of surrender."
5.In view of the above modifications, two weeks time is granted from today for deposit of such amount and for surrender. 6.The Registry is directed to carry out the necessary corrections in the order dated 29.01.2024 and re-issue a fresh order copy. 13.02.2024 ata 2/3
