This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner on 29.05.2024 wherein the petitioner is seeking for issuance of separate patta with respect to the subject property in line with the final decree that was passed in I.A.No.101 of 2022 dated 27.01.2023 on the file of District Munsif Court, Arakonam and also the order passed in the execution proceedings in EP No.19 of 2023 dated 17.02.2024 where the possession was delivered to the petitioner. 2.
Heard Mr.K.Balaji , learned counsel for the petitioner and Mr.A.Selvendran , learned Special Government Pleader for respondents 1 to 3. 3.
The grievance of the petitioner is that the subject property was specifically alloted in favour of the petitioner in the final decree proceedings and 2/5
the delivery has also been effected in the execution proceedings. In view of the same, the petitioner sought for a separate patta in his name with respect to that property which was alloted. The earlier application submitted by the petitioner through on-line mode was rejected through proceedings dated 30.07.2024. Thereafter, the petitioner once again submitted a representation along with all the relevant documents and the same was not considered. It is under these circumstances, the present writ petition has been filed before this Court. 4.
Taking into consideration the facts and circumstances of the case and considering the final decree that was passed in favour of the petitioner in I.A.No.101 of 2022 dated 27.01.2023 and the delivery which was effected in favour of the petitioner on 07.02.2024 in EP No.19 of 2023, there shall be a direction to the petitioner to submit a fresh on-line application to the 3rd respondent and the same shall be dealt with by the 3rd respondent in line with the Civil Court proceedings and a separate patta shall be issued in favour of the petitioner, if the petitioner satisfies all the other requirements. This process shall be completed by the 3rd respondent within a period of six weeks from the date of receipt of on-line application from the petitioner. 3/5

This writ petition is disposed of with the above directions. No costs.
