Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents 1 and 4 herein, with the assistance of the 5th respondent herein, to survey and fix the boundaries in S.No.614/2 measuring and extent of Hc 0.27.5 in Patta No.1861, No.18, Mallikundham Village, Mettur Taluk, Salem District, based on the application of the petitioner herein dated 18.11.2025, enabling the petitioner herein to fence his said personal property in S.No.614/2.

ORDER

This Writ Petition has been filed seeking for a direction to the respondents 1 and 4 to survey and demarcate the property, which according to the petitioner is owned by him, based on his application, dated 18.11.2025, with the assistance of the 5th respondent, within a time frame to be fixed by this Court.

2. The petitioner had submitted an application through on-line on 18.11.2025 for the aforesaid purpose. Since the same has not been Page No.2 of 6

considered by the respondents till date, the petitioner has filed this writ petition.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4 and Mr.R.Venkatesa Perumal, learned Government Advocate (Crl.Side), accepts notice on behalf of the 5th respondent.

4. No prejudice would be caused to the respondents, if the 4th respondent is directed to survey and demarcate the boundaries of the petitioner's property morefully described in the prayer to this writ petition, after hearing the objections, if any, from the neighbouring land owners as well as any other party as they deem fit within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the 4th respondent is directed to issue notice to the neighbouring land owners, and also to any other party, if they deem fit to put on notice.

(b) After receiving objections if any and after considering the same, the 4th respondent shall conduct Page No.3 of 6

survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, with the assistance of the 5th respondent, if required, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

(c) There shall be no order as to costs.
