Prayer: Civil Suit filed under Order IV Rule 1 of the Original Side Rules and under Order VII Rule 1 of the Code of Civil Procedure granting a Preliminary Decree for Partition directing the division of the suit properties mentioned in the Plain schedule by metes and bounds into two equal half shares and allot one such share and separate possession thereof to the plaintiff by appointment of a Commissioner of this Court, directing the defendants to pay the plaintiff past mesne profits in respect of the suit properties for a period of three years till the date of this Plaint and irecting the defendants to pay the plaintiff future a mesne profits in respect of the suit properties from the date of Plain till the date of allotment of one half share and separate possession thereof to the plaintiff in the entire suit properties with costs.

Since there was no appearance for the parties on previous occasions this Court directed the Registry to list the matter under the caption "for 2/4

dismissal" today. Even today there is no representation on the side of the plaintiffs as well as the defendants. Hence, this Civil Suit is dismissed for default.
