Respondent PRAYER: Criminal Original Petition is filed under Section 438 of Criminal Procedure Code to enlarge the petitioners on Anticipatory bail in the event of arrest in connection with Crime No.47 of 2016 on the file of the respondent police concerned in P.R.C.No.12/2019 on the file of Judicial Magistrate, Thiruttani on their own bond to secure ends of justice.

ORDER

(The case has been heard through video conference) The petitioners,who apprehend arrest for the alleged offences under Sections 147,148,324,307,458,459,460,506(2) of IPC r/w 149 of IPC,on the file of the respondent/Police,seek anticipatory bail.

2. The case of the prosecution is that the petitioners said to have committed alleged offences under Sections 147, 148, 324, 307, 458, 459, 460, 506(2) of IPC r/w 149 of IPC in Crime No.47 of 2017 in which the petitioner was granted bail in Crl.O.P.No.23361 of 2016 dated 09.11.2010. Subsequently another case was registered for the https://hcservices.ecourts.gov.in/hcservices/

same incident and Charge sheet was laid in P.R.C.No.12 of 2019 before the Judicial Magistrate, Thiruttani and the matter is pending for committal.

3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case. However, they are ready and willing to execute own bond. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners involved in another crime and they were granted bail by the trial court and they also executed sureties. He would further submit that in the instant case investigation was over and on filing the final report, summons have been issued by the learned Magistrate concerned.

5. Considering the facts that in respect of a connected occurrence, one more case has been registered against the petitioners wherein they have been granted anticipatory bail, the petitioners have executed sureties, the same was accepted. In the present case now summons have issued. In the above circumstances, the petitioners are directed to appear before the Judicial Magistrate, Tiruttani,and execute a own bond as directed by the learned Judicial Magistrate. With the above directions, this Criminal Original Petition is ordered.
