A.No.113 of 2020 in O.P.1007 of 2015 P.T.ASHA.J, The above application is filed for condoning the delay of 84 days in carrying out the amendment in the above Original Petition.

2. The reasons, which are given for the delay, are at paragraph 4. The same does not speak well about the manner in which the petitioner has not bothered to carry out the amendment as mandated. The reason given for this oversight is also rather surprising. The affidavit, in fact, speaks volume about the manner in which the orders of this Court are reported back to the Office and follow up on such orders. However, this Court has to see beyond the counsel to the litigant. The litigant, who has trusted a brief with the counsel, should not be allowed to suffer on account of the indifference that has been shown by his counsel. The said application is therefore allowed on condition that the counsel for the applicant shall pay a sum of Rs.5,000/- (Rupees five thousand only) to the Advocates Clerks Association by tomorrow (i.e) 22.01.2020. http://www.judis.nic.in
