Respondents Writ Petition under Article 226 of the Constitution of India, praying for issuance of a writ of certiorified mandamus, to call for the records of the fourth respondent Tribunal pertaining to its order made in OA/310/01819/2016, dated 04.01.2018, quash the same, and consequently direct the respondents 1 to 3 to appoint the petitioner on compassionate grounds in any one of the Group-C posts on considering his educational qualifications.

(Order of the Court was made by Huluvadi G.Ramesh,J.) Heard the learned counsel for the parties.
2. This Writ Petition is filed challenging the order, dated 04.01.2018, passed by the fourth respondent-Tribunal in OA/310/01819/2016, dismissing the claim of the petitioner for compassionate appointment.
3. The Tribunal dismissed the application of the petitioner on the ground that application for compassionate appointment was not submitted within time.
4. On going through the records, it is seen that the case of the petitioner for compassionate appointment was placed before the Circle Relaxation Committee on 28.07.2015. The said Committee examined the case but did not recommend the petitioner for compassionate appointment, for the reason that the relative merit point allocated to the petitioner was 64, whereas the cutoff merit point for P.A. cadre was 66, and the matter was placed in the next meeting along with other cases for consideration.
5. Considering the fact that the petitioner has secured relative merit point of 64, which is just short by two points for the cut-off point of 66, while finding no flaw in the impugned order of the Tribunal, in order to help out the petitioner in distress, we direct the respondents 1 to 3 to consider the case of the petitioner positively and sympathetically for compassionate appointment.
