This matter is listed today under the caption "For Being Mentioned" at the request of the respondent in Arb.O.P.No.358 of 2021. The respondent submits that A.No.3126 of 2021 was filed seeking payment out, and such application was allowed on 22.09.2021 subject to the provision of security by the respondent. In the order dated 16.11.2021, by which Arb.O.P.No.358 of 2021 was dismissed, the respondent was permitted to file an appropriate application for payment out of the sum of Rs.30,00,000/- which was deposited as a condition for the grant of interim stay. According to the respondent, since the payment out application was allowed earlier, a fresh application for such purpose is not necessary. However, in view of the change in circumstances in as much as Arb.O.P.No.358 of 2021 was dismissed, a fresh application, as indicated in the order dated 16.11.2021, is necessary. 04.02.2022 bsm Index : Yes/No.
