Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus, directing the third respondent to depute a competent Surveyor to measure and demarcate the land owned by the petitioner by considering her representation dated 03.05.2023. For Petitioner :

The above Writ Petition has been filed seeking a mandamus to the third respondent to consider the petitioner's written representation dated 03.05.2023.

The grievance of the petitioner is that, despite making an application on 03.05.2023 , to survey the property of the petitioner in S.No.4/5 has been sub divided into Survey Nos.4/5A, 4/5B, 4/5C, 4/D, 4/5E1, 4/5E2 and 4/6A. As per the Municipal records, the land is situated in Ward E, Block No.50, corresponding to Town Survey No.9/5A1A, 9/5A1B, 9/5A2 and 9/6A, the third respondent has not proceeded to survey the land in question.

3. Heard the learned counsels on the either side and perused the records.

4. Considering the facts and circumstances of the case, a mandamus is issued to the third respondent to conduct a survey of the petition mentioned property. The petitioner shall submit all the relevant records to show her title to the property and the respondents shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and 2/4

subdividing the property or rejecting the request. In the case of a rejection, a speaking order shall be passed. The aforesaid exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is allowed. No costs.
