Respondent Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent herein to consider and pass suitable orders on the petitioner's representation made to him on 03.10.2023 requesting him to issue no objection certificate to continue the tea shop in Chengalpattu Medical College and Hospital campus.

O R D E R

The Government has taken a policy decision of imposing ban on granting permission to run canteen, milk shop etc.,within the premises of the Government Hospitals across the State of Tamil Nadu. Such a decision has been taken by the Government in G.O.Ms.No.93, Health and Family Welfare (H2) Department, dated 25.03.2015.

As per the Government policy, public auction is to be conducted providing equal opportunity to all the aspiring candidates for putting up canteen, bunk shop or milk shop etc., within the premises of the Government Hospitals. Therefore, mere submission of representation by the petitioner would be insufficient to issue direction to the Authorities concerned to consider for grant of permission. The respondent-Dean has no

power to grant any such concession to run canteen, milk parlour shops etc., in the premises of the Government Hospitals. An administrative decision is to be taken for the purpose of conducting public auction and in the event of conducting any such public auction, the petitioner is at liberty to participate in the manner known to law.
