..Respondent(s) Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 3rd respondent to give effect to the order dated 22.08.2023 passed by the Honble Madras High Court in W.A.No.1194 of 2018 and release the lands from proceedings under the Tamil Nadu urban Land (Ceiling and Regulation ) Act, 1978 and consequently direct the 4th respondent to issue patta in favour of the petitioners. ORDER

The petitioners assert that they are the absolute owners of 5862 sq.ft. in plot nos.175 to 178 having purchased the same under sale deed dated

10.07.2006 bearing document no.7516/2006. They trace their title from one Arumugam and assert that the legal heirs of Arumugam filed W.A.No.1194 of 2018, which was allowed on 22.08.2023. On the ground that the lands currently owned by the petitioners' form part of the larger extent covered by the order of the Division Bench, the petitioners seek consideration of the request for release of lands from proceedings under the Tamil Nadu Urban Land (Ceiling and Regulation) Act, 1978.

2. Mr.T.K.Saravanan, learned Additional Government Pleader, accepts notice for all the respondents. He submits that the petitioners' representation would be considered and disposed of on merits within two months by the third respondent.

3. The petitioners rely upon order dated 22.08.2023 in W.A.No.1194 of 2018 on the basis that 5862 sq.ft. purchased by them under sale deed dated 10.07.2006 forms part of the larger extent covered by the judgment of the Division Bench. This aspect has to be verified by the third respondent while considering the representation of the petitioners. If it transpires that it is covered, the judgment of the Division Bench would hold the field and the petitioners would be entitled to the relief claimed.

4. With the above observations, the writ petition stands disposed of by directing the third respondent to consider and dispose of the petitioners' request for release by taking note of the observations in this order. There will be no order as to costs.
