PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to set aside the order dated 02.12.2022 passed by the learned XIII Metropolitan Magistrate, Egmore, Chennai in Crl.M.P.No.23827 of 2022 in C.C.No.3012 of 2019.

ORDER

This Criminal Original Petition has been filed to set aside the order dated 02.12.2022 passed by the learned XIII Metropolitan Magistrate, Egmore, Chennai in Crl.M.P.No.23827 of 2022 in C.C.No.3012 of 2019. 1/4

2. When the matter is taken up, the learned counsel for the petitioner submitted that the witness Jagadeesan whom the petitioner wanted to examine as P.W.3 had gone abroad now. Therefore, it is not possible for him to examine now. He further requests this Court to give direction to the learned XIII Metropolitan Magistrate, Egmore, Chennai, for permitting him to examine additional witness of his choice.

3. If such a petition is filed, the learned XIII Metropolitan Magistrate, Egmore, Chennai is directed to dispose the petition on merits and in accordance with law within a period of two weeks from the date of filing of such petition.

4. Accordingly, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed. 10.01.2023 ep 2/4
