(The case has been heard through video conference) Petitioners, who were arrested and remanded to judicial custody on 16.09.2020 for the offence punishable under Sections 8(c) 20 (b) (ii)(c) of Narcotic Drugs & Psychotropic Substances Act 1985 in Crime No.1466 of 2020, seeks bail.

2. The case of the prosecution is that the petitioners were found in illegal possession of 21 kgms of Ganja, which is in commercial quantity. Hence, a case has been registered.

3. The learned counsel for the petitioners would submit that the petitioner have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he seeks bail to the petitioners.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners are habitual offenders and the first petitioner is already involved in 13 previous cases and the https://hcservices.ecourts.gov.in/hcservices/

second petitioner is already involved in 10 previous cases. Hence, she strongly opposed to grant bail to the petitioner.

5. Considering the said facts and circumstances of the case and the gravity of the offence and already the petitioners are involved in number of previous cases , this Court is not inclined to grant bail to the petitioners.
