ORDER
(Order of the Court was made by N.Sathish Kumar J.) The Civil Miscellaneous Appeal has been filed challenging the order passed by the Trial Court dismissing the application filled for divorce.
2. The appellant is the wife of the respondent. She sought dissolution of marriage at the age of 75 years. Though it appears that both husband and wife were residing in the same house, disputes arose between them with regard to sharing of their property, which resulted in filing of the application for divorce. The Trial Court, upon appreciation of the evidence on record, dismissed the said application. Challenging the same, the present appeal has been preferred.
3. The learned counsel appearing for the appellant would submit that the appellant/wife died on 02.05.2025, and therefore, nothing survives for consideration in this appeal. In this regard, a memo dated 02.01.2026 has been filed.
4. The memo dated 02.01.2026 is taken on record. It is reported therein that the sole appellant died on 02.05.2025. A copy of the death certificate has also been annexed, and the same is taken on record. In view of the death of the sole appellant, nothing survives for further adjudication in this Civil Miscellaneous Appeal.
5. Accordingly, this Civil Miscellaneous Appeal is dismissed as infructuous. No costs.
