The relief sought for in the present writ petition is for a direction to direct the respondent to consider the representation submitted by the writ petitioner and revoke the order of suspension passed in D.O.No.1197/2010 (Na.Ka.No.H1/26247/07), dated 23.12.2010 by the 3rd respondent and allowed the writ petitioner to retire from service on 31.12.2010 Afternoon without prejudice to the criminal case in Cr.No.24/05 by District Crime Branch, Salem.
2. The learned counsel for the petitioner now brought to the https://hcservices.ecourts.gov.in/hcservices/
notice of this Court that the writ petitioner passed away on 19.12.2016 and meanwhile, the criminal case registered against him was also quashed by this Court. In view of the fact that the writ petitioner passed away and no further orders can be passed in the present writ petition.
3. However, it is made clear that the wife of the writ petitioner is permitted to submit a representation to the Competent Authority for the purpose of claiming Terminal and Pensionary benefits due to the wife of the writ petitioner. With these observations, the writ petition stands closed. However there shall be no order as to Costs.
