2. Learned counsel for the petitioner/Appellant is unable to get instructions as to whether the respondent has taken possession of the property during the pendency of this civil miscellaneous petition.

3. However, learned counsel for the respondent reiterates that possession has already been taken by the respondent during the pendency of this civil miscellaneous petition.

4. Since the learned counsel for the petitioner/Appellant is unable to get instruction from his client, this Court is constrained to believe the submissions made by the learned counsel for the respondent.
