The petitioner who was arrested and remanded to judicial custody on 25.01.2022, seeks bail in S.C.No.115 of 2018 for the offence punishable under Sections 147, 148, 341, 302 read with Section 149 of IPC, in Crime No.3233 of 2015, registered on the file of the respondent. 1/4

Learned counsel for the petitioner submitted that the petitioner is facing trial in S.C.No.115 of 2018 on the file of the learned Additional District & Session Judge, Chengalpattu and subsequently, he had not appeared before the trial Court, and non-bailable warrant was issued on 26.07.2018 and the same was executed on 25.01.2022. He also submitted that the petitioner will undertake that hereafter he will regularly appear before the trial court on all hearing dates and also stated that he is prepared to comply with any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that in this case almost all the witnesses were examined and the accused have been co-operated with the trial process and they have also filed several petition for recall and thereby stalled the trial process and they have been indulging in tampering the witnesses.

4. This Court has also called for report from the concerned trial Court and it revealed that though trial was started in the year 2024, several petitions have been filed by the petitioner one along with other accused, which resulted in delay in trial process.

5. Considering the fact that the trial in this case is pending from the year 2016, this Criminal Original Petition is dismissed.
