ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioners who were arrested and remanded to judicial custody on 08.12.2021 for the offences under Sections 273, 328 of IPC r/w 7(1) 20(1) of COTPA act,2003 in Crime No.534 of 2021, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioners were found in illegal possession of 3645 kgs of Contraband Tobacco Products. Hence the complaint.
3.The learned counsel for the petitioner would submit that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated. He would further submit that the petitioners have been suffering incarceration from 08.12.2021. Hence, he would pray for grant of bail. 4.The learned Government Advocate (Crl. Side) raised objection stating that the petitioners found in illegal possession of 3645 kgs of contraband Tobacco Products worth about Rs.23,00,000/-. He further submits that already this Court dismissed the petitioner's bail petition in Crl.O.P.No.23509 of 2021 dated 23.12.2021. https://hcservices.ecourts.gov.in/hcservices/
5. Considering the gravity of the offence committed by the petitioner and also considering that there is no change of circumstances observed, this Court is not inclined to grant bail to the petitioners.
