ORDER

This petition has been filed challenging the order of the second respondent in Na.Ka.No.A3/ 1233/ 2020 dated 3.05.2023, quash the same and further direct the 2nd respondent to consider the petitioners application dated 26.04.2023 for renewal of license for trading in Kerosene under the provisions

of the Tamil Nadu Kerosene (Regulation of Trade) order 1973.

2. It is the case of the petitioner that the petitioner was a licensee under the provisions of Tamil Nadu Kerosene (Regulation of Trade) Order. The license is valid upto 31.12.2022. The petitioner made application for renewal, however, the same was rejected. Hence, this petition.

3. The learned counsel for the petitioner submitted that the petitioner may be permitted to make a fresh application for renewal of license under the Tamil Nadu Kerosene (Regulation of Trade) Order, 1973.

4. It is the contention of the learned Additional Government Pleader as per Regulation 5(7) of the Tamil Nadu Kerosene (Regulation and Trade) Order, 1973, the petitioner ought to have made an application not less than two months from the date of the expiry of the Retail Registration Certificate, however, the petitioner has made an application only on 26.04.2023, therefore, the rejection order is passed. Hence, seeks for dismissal of the writ petition,

5. Heard both sides and perused the materials placed on record. 6.Considering the facts and circumstances of the case, this Court without going into the merits of the case permits the petitioner to make fresh application

seeking renewal of license under Tamil Nadu Kerosene (Regulation of Trade) Order,1973 and the official respondents are directed to consider the application of the petitioner and pass appropriate orders on merits and in accordance with law without reference to the impugned order dated 30.05.2023 within a period of six weeks from the date of receipt of a copy of this order.
