India, praying for issuance of writ of Certiorarified Mandamus, directing to call for the records in relates to the rejection order passed by the third respondent in Na.Ka.No.1066/A3/2013 dated 28.07.2014 and quash the same and consequently direct the third respondent to grant permission for the petitioner's School to fill up the 2- Secondary Teacher post and 1BT(Maths) Assistant post. ORDER

When the matter came up for consideration earlier on 12.11.2024 the learned counsel for the petitioner submitted that, inspite of repeated communications, there is no response from the petitioner and hence reported ''no instructions''. The matter was again listed on 13.11.2024 with the petitioner's name duly printed in the cause list. At that stage, the learned counsel for the petitioner who reported ''no instructions'' on an earlier occasion and sought time to inform the petitioner once again. 2.Today (20.11.2024) when the matter is listed under the caption ''for dismissal'', the learned counsel for the petitioner once again 2/6

submitted that the petitioner is not responding. Further, the above writ petition was filed against an order rejecting permission to fill up the posts of 2- Secondary Grade Teachers and 1-B.T.(Maths) Assistant in the year 2014. In view of the long lapse of time almost about a decade, the question of granting permission to fill up those vacancies at this stage may not arise. In case, if the petitioner has not any right to fill up such vacancies, it is open for the petitioner to approach the respondents once again afresh, without reference to the order already passed. In case if any such proposal is submitted by the petitioner, the same shall be considered by the respondents strictly in accordance with law, on its own merits without reference to the impugned order. 3.Subject to the above observations, the writ petition stands dismissed. No costs.
