ORDER

The Criminal Original Petition has been filed by the petitioner under Section 482 of Cr.P.C., to withdraw the crime number 318 of 2013 pending on the file of the 2nd respondent and transfer the same to the file of the 3rd respondent.

2.The learned Additional Public Prosecutor would submit that the crime No.318 of 2013 has been closed as mistake of fact on 11.10.2016 and a closure report has also been filed. 3.In view of the above submissions made by the learned Additional Public Prosecutor, the prayer sought for in this petition has become infructuous. The 2nd respondent police is hereby directed to issue a copy of the closure report to the petitioner if not served.

4.Accordingly, this Criminal Original Petition stands dismissed as infructuous.
