Rayaroth Balakrishnan Nambiar v. P.Bhargavi (Died)
C.M.P.Nos.522, 523 & 524 of 2015 in S.A.No.384 of 2005 C.V.KARTHIKEYAN.J, These three applications have been filed seeking to condone the delay of three days in filing an application to set aside the abatement, to set aside the abatement and to bring on record the legal representatives of the deceased 1st respondent / P.Bhargavi as 8th, 9th and 10th respondents. 2.Perusal of the records reveal that the 1st respondent / P.Bhargavi herself had been brought on record as legal representatives as original plaintiff in the suit and naturally, since the Second Appeal had been admitted and the substantial questions of law had been framed, it would only be appropriate, that the legal representatives are given an opportunity to canvas the Second Appeal on merits and on the basis of the substantial questions of law. Taking into consideration the further fact that the Civil Miscellaneous Petitions had been filed in the year 2015, I would allow all the three Civil Miscellaneous Petitions 2/2 https://www.mhc.tn.gov.in/judis
