JUDGMENT

[Judgment of the Court was made by S.S.SUNDAR, J.,] The above appeal is filed as against the judgment and decree of the Trial Court dismissing the suit for specific performance filed by the plaintiff / appellant 1/4

in O.S.No.61 of 2008 dated 21.06.2012 on the file of the learned I Additional District Judge, Erode.

The learned counsel appearing for the appellant has filed a Memo dated 17.10.2022 indicating that the litigation is settled by parties out of Court. 3.

In view of the settlement arrived at between the parties, the learned counsel seeks permission of this Court to withdraw the above appeal. 4.

Recording the submission of the learned counsel appearing for the appellant, the above appeal is dismissed as withdrawn. Registry is directed to refund the Court fee paid in the above appeal to the learned counsel for the appellant.
