Respondent Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 16.7.2018 and thereby direct to grant permission to the petitioner to conduct the cultural programme in the Arulmigu Sri Sakthi Mariamman Temple Festival which is going to be held on 5.8.2018.

ORDER

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 16.7.2018 and thereby directing to grant permission to the petitioner to conduct the cultural programme in the Arulmigu Sri Sakthi Mariamman Temple Festival which is going to be held on 5.8.2018.

2. The learned counsel appearing for the petitioner submitted that the petitioner is a resident of Kudiyatham Taluk, Vellore District and also claims to be one of the members of the Vizha Commttee. Since the committee has been conducting the cultural programmes as a part of temple festival every year in a peaceful manner without any untoward incident in the past, he has submitted a representation to the respondent on 16.07.2018 seeking permission to conduct the cultural programme on 05.08.2018. As the said representation has not been considered by the respondent so far, the petitioner is before this Court.

3. The learned Additional Government Pleader appearing for https://hcservices.ecourts.gov.in/hcservices/

the respondent submitted that as there was a case registered last year in connection with an incident that took place during the temple festival before the concerned court, the Inspector of Police is unable to grant permission to conduct the cultural programme this year, which is a part of the temple festival. 4.

Considering the facts and circumstances of the matter, this Court hereby directs the respondent to grant permission to the petitioner to conduct the cultural programme in the Arulmigu Sri Sakthi Mariamman Temple Festival which is going to be held on 5.8.2018 by issuing suitable conditions.
