(Order of the Court was made by M.SATHYANARAYANAN, J.) Heard the submissions of the learned counsel appearing for the petitioners, who would submit that on account of the change of counsel, many documents have to be recovered with some difficulty and the case bundle was reconstructed and the papers were represented. In the light of the said fact, the delay in representing the papers cannot be construed as neither wilful nor wanton and prays for allowing the petition.
2. Per contra, the learned counsel appearing for the second respondent/original applicant strenuously opposing this petition by submitting that the reasons assigned are administrative in nature, and in the light of the delay of more than one year in representing the papers, such huge delay cannot be condoned and prays for dismissal of this petition.
3. This Court has considered the rival submissions and also perused 1/3
the materials placed before it and being satisfied with the reasons assigned in paragraph-3 of the affidavit, this petition is ordered and the delay in representation is condoned. If the papers are otherwise in order, Registry is directed to number the writ petition and list it for admission by printing the name of Mr.K.M.Ramesh, learned counsel appearing for the second respondent.
