The Govt Of Tamilnadu v. M/S Deccan Fun Islands
CMP No.2521 of 2023 in AS No.864 of 1994 CMP No.2521 of 2023 in AS No.864 of 1994 R. SUBRAMANIAN, J.
This miscellaneous petition has been filed for a huge delay of 1896 days is sought to be explained as follows:
"The application should have been filed within 30 days i.e., 30.10.2017. It is not within the knowledge of the petitioner herein about the order passed by this Hon'ble Court, dated 04.09.2017. Only when the first respondent sent a letter dated 01.02.2019 which was sent for verification, the Field officers found that the appeal was dismissed for non prosecution. The Government has took all efforts to prosecute the case effectively. Even Additional Advocate General was nominated to defend the case."
2. This explanation to my mind is wholly unsatisfactory. Therefore, this application is dismissed. It will be open to the Government to recover the loss from the Law Officer or the Officer incharge of the case. 15.12.2023 jv https://www.mhc.tn.gov.in/judis 1/2
