ORDER

The impugned order passed by the second respondent in Na.Ka. No.AA3/ 2632 / 2022 dated 15.11.2022, is put under challenge in the present Writ Petition. Further, the petitioner has sought for a direction to the second respondent to provide road, drinking water tank and water pipeline connection, street lighting, electricity, drainage and sewage in accordance with law.

2. Heard the learned counsels appearing on either side.

3. The learned counsel for the petitioner submitted that the petitioner is the owner of the property situated in Periyar Nagar, Lakshmi Narayanapuram, Panruti Taluk, Cuddalore. He further submitted that the petitioner made several representations to the local authorities for providing basic amenities to the said area and in relate to the said issue, he has also sent a letter dated 03.10.2022 to the respondents, however, the second respondent passed the impugned order on 15.11.2022 rejecting his request on the ground that with regard to the subject issue, a suit was filed in O.S.No.70 of 1985 and corresponding execution proceedings are pending. He contended that mere pendency of the suit and corresponding execution petitions and applications cannot be taken as a ground

to reject the petitioner's request and hence, the petitioner has come forward with the present Writ Petition.

The learned counsel for the third respondent submitted that in regard to the subject issue, the petitioner as power agent, as well as his wife, has filed a petition under Section 47 of CPC in E.A.No.156 of 2007 & E.A.No.387 of 2016 in E.P.No.44 of 2000 in O.S.No.70 of 1985 before the Sub Court, Panruti respectively and the same are pending.

Considering the facts and circumstances of the case and also taking note of the submissions made by the learned counsel on either side and since the petitions filed on the side of the petitioner in E.A.No.156 of 2007 & E.A.No.387 of 2016 in E.P.No.44 of 2000 in O.S.No.70 of 1985 are pending, this Court grants liberty to the petitioner to make a fresh representation to the local authorities after disposal of the aforesaid execution applications.

6. With the above observation and direction, this Writ Petition is disposed of. There shall be no order as to costs.
