CMP.Nos.409 to 411 of 2012 & S.A.No.431 of 2005 KRISHNAN RAMASAMY.J., These petitions have been filed praying (i) to condone the delay of 1230 days in filing the petition to set aside the abatement caused due to the death of the first respondent in the above Second Appeal, (ii) to set aside the abatement caused due to the death of the first respondent in the above second appeal, (iii) to permit the petitioner/appellant to bring on record the respondents 4 to 8 as the legal heirs of the deceased first respondent and rank them as respondents 4 to 8 in the above second appeal, respectively. 2.No representation for the petitioner/appellant. Mr.A.Muthu Kumar, learned counsel entered appearance for the respondents. 3.The learned counsel for the respondents has no objection in allowing these petitions.

KRISHNAN RAMASAMY.J., dn 3.Therefore, considering the averments made in the affidavits filed in support of the respective petitions and also no objection being stated by the learned counsel for the respondents, these petitions are allowed. 4.Registry is directed to carry out necessary amendments in the cause title on or before 28.09.2022. Thereafter, Registry is also directed to issue notice to the newly impleaded respondents 4 to 8 returnable by 28.10.2022. 5.Private notice is also permitted.
