ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 379, 430 of IPC, 1860 in Crime No.620 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the respondent police parties are routine checkup of sand theft in the Vanniyavedu Pallar River area, at the time, the petitioner along with 3 others are joined together involved in sand theft. When the respondent police intercepted the vehicle, at the time, the petitioner and another person run away from the occurrence place and leaves the vehicle. When the respondent police had found in vehicle that there was an illegally transport of 1 unit of sand without valid license and committed mischief by doing damage of river by taking it out of the possession of the authority, in sum and substances, allegation against the petitioner is he had participates in the crime. Hence the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) submitted that 2 previous cases pending against the petitioner, one is 302 there is goondas proposal. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of this case, as per the objection raised by the learned Government Advocate (Crl. Side), this Court is not inclined to grant anticipatory bail to the petitioner.
