2. Heard learned counsel for appellant, who brings to notice that the present appeal is before this Court pursuant to leave therefor having been granted.

In keeping with the decision of the Full Bench of this Court in S.Ganapathy v. Senthil Vel [2016 (4) CTC 119], appellant has to prefer an appeal before the District Court. The Criminal Appeal shall stand dismissed. Of course, in seeking condonation of delay, if any, in preferring such appeal, it is open to the appellant to explain the delay.
