PETITION under Section 11 of the Contempt of Courts Act, 1971 praying to punish the respondent under the Contempt of Court Act for deliberately disobeying the order dated 22.01.2024 passed by this Court in Crl.OP No.942 of 2024.

ORDER

Ms.Sukhila, Inspector of Police, GNT Road, Madhavaram, Chennai 600 060, is present before this Court at the time of hearing. 2.

This Contempt petition has been filed against the respondent for wilful disobedience of the order of this Court in Crl.OP No.942 of 2024 dated 22.01.2024.

When the matter was taken up for hearing today, the affidavit of the respondent is filed and the relevant portions are extracted hereunder :-

10. I submit that during the course of investigation the then Inspector of Police examined the 12 witnesses and also collected the medical report of the deceased.

11. I further submit that during the course of investigation, it came to light that on the day of occurrence, the deceased 2/4

consumed Alcohol and he was in the intoxication condition, so he drove the vehicle in a rush and negligence manner and fell in the dig.

I submit that after completion of detailed and elaborate investigation the then inspector of Police closed the FIR No.607/2016 as Further Action Dropped (FAD) and the same was filed before the learned Judicial Magistrate, Thiruvottiyur through E-filing NO.LTN 0002590C202400102 dated 14.05.2024.

In the light of the above development, liberty is granted to the petitioner to work out his remedy before the concerned Jurisdictional Court by filing a protest petition and proceed further in accordance with law. 5.
