Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition that "the petitioner/appellant shall appear before the said court at 10.30 a.m., on the first working day of every English Calendar month, pending appeal", in the order passed in Crl.M.P.No.5166/2021 in Crl.M.P.No.2224/2020 in C.A.NO.116/2020, dated 26/04/2021 and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.R.RADHA PANDIAN, Advocate for the petitioner and of M/S.K.SRINIVASAN, Special Public Prosecutor for CBI Cases on behalf of the Respondent the court made the following order:- Originally, this Court by an order dated 20.02.2020 suspended the sentence with a condition that the petitioner shall appear once in a month before the learned XIII Additional Special Judge for C.B.I. Cases, Chennai at 10.30 a.m until further orders. Subsequently, this Court by an order dated 26.04.2021 modified the condition that the petitioner shall appear before the trial court once in three months. Now, seeking further modification, the present Criminal Miscellaneous Petition has been filed.

2. Considering the fact that this court already modified the condition that the petitioner shall appear before the trial court once in three months, no further modification is required at this stage and there is no merit in this petition. Hence, this Criminal Miscellaneous Petition stands dismissed.
