Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondent to transfer the patta in my grandfather children's name and their children's name jointly for the above lands in an extent of 5290 sq.ft. comprised in Survey No.2381/84 situated in Bazaar Road, Mylapore Village, Mylapore Taluk, Chennai District.

ORDER

The petitioner is stated to have inherited a certain property through a family partition. The patta bearing No.541 for the said property stood in the name his grandfather Late.Kannialal. For transfer of patta, the petitioner has filed a representation dated 10.05.2019, and has also paid necessary charges for the said purpose. But, till date no action has been taken by the respondent. Hence, the petitioner has filed the present writ petition.

2. Heard the learned counsel for the petitioner. Mrs.R.Janaki, learned Additional Government Pleader entered appearance for the respondent and makes a statement on instructions that an enquiry is scheduled to take place at 3.00 p.m., on 10.02.2021, in the office of the respondent. The said statement is recorded.

Inasmuch as a date for enquiry is fixed by the respondent, no direction is required to be given except that the respondent is directed to hold an enquiry after issuing notices to all the parties who are likely to be affected by his decision, and after providing the parties a fair and effective hearing and to dispose the matter through a speaking order within a period of eight(8) https://hcservices.ecourts.gov.in/hcservices/

weeks from 10.02.2021. The petitioner is now required to appear before the concerned authority on the date fixed for the enquiry.

4. The writ petition is disposed of with the above directions. No costs.
