Prayer in WP.No.32131 of 2018 : Writ Petition has been filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records of the first respondent dated 05.01.2018 vide proceedings ROC.No.344/2018/T1 and to quash the same and consequently, direct the respondent to reinstate the petitioner in service.

JUDGMENT

2. This appeal has been filed by the appellant against the order of this Court passed in W.P.No.32131 of 2018 dated 09.09.2019, wherein the prayer of the appellant seeking quash of the order passed by first respondent dated 05.01.2018 and https://hcservices.ecourts.gov.in/hcservices/

consequently, to reinstate the appellant in service, was rejected.

3. Today, when the matter is taken up for consideration, learned counsel for appellant submits that the respondents have revoked the suspension order and the petitioner was reinstated in service. Therefore, nothing survives for further adjudication in the matter. Learned counsel further submits that though this Court, under order dated 24.03.2020, directed the respondents to pay the subsistence allowance at the rate of 75% from July 2019 to till date within a period of four weeks from the date of receipt of that order and thereafter, shall continue to pay the subsistence allowance, till date, the subsistence allowance has not been paid.

4. Learned Additional Government Pleader appearing for respondents submits that subsistence allowance, as directed by this Court, will be paid to the appellant within a period of four weeks from today.

Recording the submission of learned Additional Government Pleader, the Writ Appeal is disposed of. No costs. Connected miscellaneous petitions are closed.
