PRAYER : Contempt Petition filed under Section 11 of the Contempt of Court Act, 1971, praying to punish the respondent for Civil Contempt and for willfully disobeying the order passed by the High Court in W.P. No. 10540 of 2011 dated 06.09.2019 with costs.

Pursuant to the orders passed by this Court on 05.03.2020, the Superintendent Engineer is present before this Court.

2. Learned Counsel for the respondent submitted that tariff concession has been worked out and a cheque has been brought today in favour of the petitioner.

3. Learned counsel for the petitioner submitted that this cheque can be sent directly to the party. Learned counsel further submitted that if, in case, there is any error in calculation or any other amount is payable to the petitioner, the petitioner must be permitted to make separate representation to the respondent to make a claim.

4. In view of the above development, the respondent is directed to send the cheque to the petitioner, forthwith. It is also left open to the petitioner to workout their remedy if, in case, they find that there is any error in calculation and any balance amount requires to be paid to the petitioner.
