ORDER

The Criminal Original Petition has been filed by the petitioner to withdraw the entire case diary in Crime No.279 of 2015 from the file of the 5th respondent and hand over the same to the 3rd respondent and further direct the 3rd respondent to depute an officer not below the rank of the Superintendent of police to investigate the case and file a final report within a stipulated time fixed by this Court.

2.The petitioner seeks direction of this Court to withdraw the Crime No.279 of 2015 pending on the file of the 5th respondent namely the Inspector of Police, Chengalpattu Taluk Police Station, Kancheepuram District and transfer the investigation to the 3rd respondent i.e. The Superintendent of Police, CBCID, Egmore, Chennai. The crime is of the year 2015, now, almost four years have been lapsed and hence, due to the lapse of period, the prayer sought for by the petitioner cannot be considered now.

3.Considering the long pendency of the case, the 5th respondent is hereby directed to complete the investigation in Crime No.279 of 2015 and file a final report within a period of four weeks from the date of receipt of copy of this Order, before the jurisdictional Magistrate, if not already filed.

4.With the above direction, this Criminal Original Petition stands disposed of.
