Respondents Prayer in SA No. 711 of 2023 : This Second Appeal is filed under Section 100 of the Code of Civil Procedure, to set aside the Judgment and Decree dated 11.07.2022 made in AS.No.10 of 2019 on the file of Subordinate Judge, Dharapuram in confirming the Judgment and Decree dated 29.03.2019 made in OS.No.125 of 2007 on the file of the District Munsif Court, Dharapuram with reference to appellants right over item 1, 5 and 6 of suit property . Prayer in SA No. 401 of 2024: This Second Appeal is filed under Section 100 of the Code of Civil Procedure, to allow the Second Appeal by setting aside the judgment and decree passed in A.S.No.10 of 2019 dated 11.07.2022 on the file of the Subordinate Judge, Dharapuram reversing the Judgment and Decree passed in O.S.No.125 of 2007 dated 29.03.2019 on the file of the District Munsif Court, Dharapuram.

Mr.N.Ponraj for R1 No appearance for R2 COMMON ORDER S.A.No.711 of 2023 is filed against the judgment and decree dated 11.07.2022 passed in A.S. No.10 of 2019 on the file of the learned Subordinate Judge, Dharapuram, confirming the judgment and decree dated 29.03.2019 passed in O.S. No.125 of 2007, on the file of the District Munsif, Dharapuram.
2. S.A.No.401 of 2024 is filed against the judgment and decree dated 11.07.2022 passed in A.S. No.10 of 2019 on the file of the learned Subordinate Judge, Dharapuram, reversing the judgment and decree dated 29.03.2019 passed in O.S. No.125 of 2007, on the file of the District Munsif, Dharapuram.
3. With the consent of both the parties, the matter was referred to the District Mediation Centre, Tiruppur, for arriving at an amicable settlement between the parties. Accordingly settlement was arrived at between the parties and a Mediation Report of the District Mediation Centre, Tiruppur, along with a Partition Deed dated 18.12.2025 registered vide Document No.11316 of 2025 entered into between the parties, duly signed by both the appellant and the respondents and their counsels, is filed and the same is recorded.
4. The Second Appeals in S.A. Nos.711 of 2023 and 401 of 2024 are disposed of in accordance with the settlement arrived at between the parties in the District Mediation Centre, Tiruppur. The Partition Deed shall form part of the decree in S.A. Nos.711 of 2023 and 401 of 2024. Consequently, connected miscellaneous petition is closed. No costs.
