JUDGMENT

[Judgment of the Court was delivered by S.S.SUNDAR, J.,] (1) Learned counsel for the appellants earlier reported the death of appellants 1, 3 and 6. However, steps were not taken. The learned counsel states that he is unable to get instructions from his clients to take steps.

(2) Hence, the Appeal Suit is liable to be dismissed as abated insofar as appellants 1, 3 and 6 are concerned.

(3) However, it is stated by the learned counsel for the appellants that notice had already been sent to the parties on 19.10.2022. Despite notice being served on the parties, the learned counsel for the appellants is unable to get instructions from

his clients. Hence, this Court is of the view that no useful purpose will be served by issuing another notice to the appellants. (4) Hence, the Appeal Suit stands dismissed for non prosecution.
