ORDER

The present criminal original petition has been filed to direct the respondent police to register the petitioner's complaint dated 22.12.2015 in CSR.163/CSR/K2 X/15.

2. In the petition, it has been stated that the counter petitioner, namely, Padmanaban, was working as a Supervisor in the petitioner's company for 8 years since 2007 and he stopped coming for his job from 01.06.2015. Thereafter, he contacted the Managing Director of the company through phone and asked to comply with the Provident fund application formalities and the Managing Director insisted the said Padmanaban to come in person and submit a letter so as to process the provident fund application. Only after receipt of the rejected P.F application of the said Padmanaban from the concerned government Office, the petitioner came to know that the accused has committed forgery by making false rubber stamp in the name of the petitioner's company and used the same in the P.F. Application and also forged the signature of the Managing Director of the petitioner's company in the said P.F application. Hence, the petitioner has lodged a complaint on 22.12.2015. But, till date, no action has been taken on the said complaint. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing https://hcservices.ecourts.gov.in/hcservices/

for the respondent.

4. The learned Additional Public Prosecutor submitted that that on receipt of the complaint of the petitioner, C.S.R. No. 163/ CSR/K2X/15 has been assigned and the same is pending for enquiry.

5. In view of the submissions made on either side, this Court directs the respondent to conduct enquiry on the complaint of the petitioner dated 22.12.2015 in CSR.163/CSR/K2X/15 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, he is directed to proceed further in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
