Crl.M.P.No.1285 of 2024 in Crl.A.SR.No.463 of 2024 M. NIRMAL KUMAR , J This petition is filed to condone the delay of 4 days in filing the above Criminal Appeal.

2. The petitioner/complainant has filed a private complaint against the respondent for offence under Section 138 of N.I.Act. The trial Judge vide judgment dated 26.02.2018 had dismissed the complaint and acquitted the respondent/accused. Thereafter, the appeal has been filed in Crl.A.No.153/2018, before the Principal Sessions Judge, Vellore and it was pending. Thereafter, in view of Full Bench judgment in K.Rajalingam Vs.

R.Sujanthalakshmi, 2020 (4) CTC 1, the case was returned on 19.10.2023 to be presented before this Court in which, 4 days delay had occurred.

3. The petitioner has taken private notice to the respondent and the postal cover has been returned as no such person. Private notice to the counsel, who had appeared before the trial Court and notice have been served.

4. Today, there is no representation for the respondent showing there is no serious objection. Further, in this case there is only 4 days delay. Hence, the delay stands condoned and the petition is ordered.
