This petition has been filed to quash the proceedings pending in C.C.No.2649 of 2018 pending on the file of the learned II Additional Metropolitan Magistrate Court-Allikulam, Egmore in connection to the Crime No.33 of 2018, Inspector of Police, G-3 Kilpauk Police Station, Chennai District. 2.Heard the learned counsel for the petitioners and the learned counsel appearing on behalf of the respondent.
3.The case of the prosecution is that the accused persons who were traveling in a bus from ICF to Thiruvanmiyur got on the top of the bus and started singing and raising slogans in filthy manner. Thereby, they caused disturbance to the general public and the co-passengers. Hence, all the accused persons were secured and brought before the Police Station. Based on this incident, an FIR came to be registered in Crime No.33 of 2018 for offence under Sections 294(b), 290 of IPC and Section 177 read with 123(2) of the Motor Vehicles Act. 4.Taking into consideration the age of the accused persons during the relevant 2/4
point of time and also of the fact that they were all college going students and they had indulged in such activities without knowing the consequence and all these students will have to pursue further in their life and it should not unnecessarily affect their carreer due to the pendency of the criminal proceedings, this Court is inclined to exercise its jurisdiction under Section 482 of Cr.P.C., and quash the entire proceedings.
5.In the light of the above reasoning, the proceedings in C.C.No.2649 of 2018 pending on the file of the learned II Additional Metropolitan Magistrate CourtAllikulam, Egmore, is hereby quashed in its entirety. 6.In the result, this criminal original petition stands allowed.
