ORDER

Heard the learned counsel for the petitioner.

2. Learned counsel for the petitioner would bring to my notice that the petitioner is not able to muster necessary funds to comply with the conditional order. He would further state that in respect of another suit, he has recently deposited a sum of Rs.6,83,811/- and hence, she has no money to comply with the order passed on 28.08.2025.

Learned counsel for the respondent however opposes the said request stating that the payment made was in respect of entirely different suit viz., O.S.No.5925 of 2019 which is totally irrelevant to the present revision which arises out of O.S.No.5070 of 2020. The parties are also different excepting that the petitiner is the defendant in both the suits.

4. Considering the request made by the petitioner and also the inability expressed, I am inclined to modify the order dated 28.08.2025 directing the petitioner to deposit a sum of Rs.4,00,000/-(Rupees Four Lakhs Only) instead of 50% of the suit claim on or before 09.02.2026.

It is made clear that there shall be no further extension of time under any pretext whatsoever.
